Tanna Adventures - Terms & Conditions.

Please read carefully. By booking with Tanna Adventures you accept & are bound by these Conditions.

[ 1 ]INTERPRETATION AN DEFINITION.

1.01
'Tanna Adventures Website', ‘Website’, 'Site' means the information portal at www.tanna-adventures.com.


1.02
'Terms and Conditions','T and C', 'T & C', 't&c', 'Agreement', 'Contract' shall mean the set of provisions, rules and standards that form the agreement between 'Customers' (including both 'Guests' and 'Participants') and 'Tanna Adventures' for Accommodation, and/or Activities in Vanuatu.


1.03
'Tanna Adventures', 'Us', 'We', 'owner' shall mean Tanna Adventures.


1.04
'Tanna Adventures Property', 'Property', 'Premises' shall mean the traditional custom land of the Kapum Family, Middlebush, Tanna Island, Vanuatu.


1.05
'Customers' shall mean either 'Guests' ( defined by clause 1.06 below), or 'Participants' ( defined by clause 1.07 below), or both 'Guests' and 'Participants' ( defined by clauses 1.06, and 1.07 below). If a customer is both a guest and a participant, then clauses referring to each in term shall also apply to the other concurrently. If there is a conflict then the most restrictive or limiting to the customer shall apply.


1.06
'Guests', 'You', 'Your', 'Your Party', 'members' shall mean the entity, entities, person, and/or persons that have agreed to occupy, stay at, and use the 'Tanna Adventures Property'. By definition the entity / person addressed on the 'Confirmation Email' and 'Formal Documents' is the 'Guest', but shall include all persons included within the numbers of persons booked by that entity / person and included in the numbers stated in that 'Confirmation Email'. You formally become 'Guest(s)' by paying 'Tanna Adventures' a 'Deposit' for the accommodation period stated in the 'Confirmation Email', and as soon as deposited funds have cleared in the 'Tanna Adventures' bank account.


1.07
'Participants', 'You', 'Your', 'Your Party', 'members' shall mean the entity, entities, person, and/or persons that have agreed to participate in or on a Tanna Adventures 'Tour' or 'Walk' or any other activity arranged or organized by Tanna Adventures. By definition the entity / person addressed on the 'Confirmation Email' and 'Formal Documents' is the 'Participant', but shall include all persons included within the numbers of persons booked by that entity / person and included in the numbers stated in that 'Confirmation Email'. You formally become 'Participants(s)' by paying 'Tanna Adventures' a 'Deposit' for the accommodation period stated in the 'Confirmation Email', and as soon as deposited funds have cleared in the 'Tanna Adventures' bank


1.07
'Accommodation', 'stay' shall mean staying in one of the Bunglows ( oe Nima) owned by Tanna Adventures on their property, and detailed on the website.


1.08
'Tours & Walks', 'Tours', 'Walks', 'Activities' shall mean one of the organized tours or walks arranged by Tanna Adventures, and detailed on the website.


1.09
'Confirmation Email', 'Formal Documents', shall mean the email sent by 'Tanna Adventures' to the 'Customer(s)' which states the following details :


(a)
The Name of the Customer(s). This may only be one name but identifies the whole group and shall mean every person in this group of Customers(s).


(b)
The number of the Customers(s), and by definition the number stated shall be definition be all the 'Customers(s), regardless of whether they have been specifically named or not.


(c)
The range of dates for which the 'Accommodation' or 'Tours & Walks' covers

(d)
The 'Commencement' date.

1.10
'Commencement' shall mean either th commencement of your first 'Tour' or 'Walk' with us, and / or the first day of your 'Accommodation'.

1.11
"Deposit' shall mean the amount of money you are required to pay us to secure confirmation of your travel arrangements with Tanna Adventures. Travel arrangements include either Accommodation or 'Tours & Walks, or both as a combination. The Deposit is paid in either American (US$), European (Euro), Australian (AU$), or New Zealand (NZ$) Currency, and can be paid by either by PayPal, credit card (Visa or MasterCard only ) or Bank Transfer. Bank or Credit Card Fees apply.

1.1.10
'Final Payment' shall mean the amount of money required to pay for all Accommodation, Tours, Walks, Meals(if chargeable), extra Services and Products for your Time with Tanna Adventures minus the amount of Deposit Paid. The Final Payment is generally to be paid to Esso in Vatu at the end of your Trip.

[ 2 ]GENERAL TERMS AND CONDITIONS.

2.01
Your Responsibility to Inform Yourself: It is your responsibility to have read and understand these Terms and Conditions before making a booking and paying a deposit.


2.02
Our Right to Change these Terms and Conditions: We reserve the right to change all or part of these Terms and Conditions at any time.


2.03
Information on Tanna Adventures and Associated Websites: While Tanna Adventures makes every effort to ensure that information on the website is current and kept up to date, this information may change without notice. Descriptions, details and advice is made in good faith and all photos on this 'Website' were taken 'on site' and are provided as a guide only.


2.04
Your Access to Website is Conditional: Your access to the Site is conditional upon your acceptance of and compliance with all terms, conditions, notices and disclaimers set out in these Terms and Conditions.


2.05
Material Content Disclaimer: Tanna Adventures makes no representations about the content and suitability for any purpose of the information contained in the Site. It is provided "as is" without an express or implied warranty of any kind. Tanna Adventures disclaims (to the full extent allowable by law) all warranties with regard to this information (including any advertisements), including all implied warranties as to merchantability or fitness for use. Tanna Adventures shall not be liable for any damages whatsoever including any special, indirect or consequential damages resulting from loss of use, data or profits, whether in an action in contract, negligence or other tort or statute arising out of or in connection with access to the Site or the use or performance of information contained in it. Neither Tanna Adventures nor any of its employees participating in the provision of information to the Site warrant that the Site will be uninterrupted or error-free.


2.06
Indemnity: Tanna Adventures will not be responsible for any actions taken by you if you act in any manner which is inconsistent with these Terms and Conditions. By accessing the Site you agree to indemnify and hold harmless Tanna Adventures, its employees and agents from and against all actions, proceedings, suits, claims and demands brought or made against Tanna Adventures by any person arising from or as a consequence of such an action and from and against any damage, loss, cost or expense suffered or incurred by Tanna Adventures as a direct or indirect consequence of that action.


2.07
Severance: If any provision of this agreement is found to be void, unenforceable or illegal it is to be read down so as to be valid and enforceable, or if that cannot be done, the provision (or where possible the offending words) is to be severed from this agreement without affecting the validity, legality or enforceability of the remaining provisions of this Agreement which will continue in full force and effect.


2.08
Photos and Marketing: You consent to us using images of you taken during your travel with Tanna-Adventures, for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.


2.09
Claims and Complaints: If you have a complaint about your trip please inform your tour guide at the time in order that they can attempt to rectify the matter. Alternatively, inform Esso when you are back at the TannaAdventures Property. If satisfaction is not reached through these means then any further complaint should be put in writing (email) to us within 28 days of the end of your travel with us.


2.10
Governing Law to Terms and Conditions: The Laws governing these Terms and Conditions, shall be the laws of the Country of Vanuatu. The version of Law that shall be applicable to these Terms and Conditions' is the English version. The French version shall not apply.


[ 3 ]BASIS OF ACCOMMODATION CHARGES.

3.01
CHARGES FOR ADULTS, CHILDREN AND INFANTS:


(a)
Adults are charged at full rates as detailed on our website and booking engine, and any person twelve(12) and over are considered for Accommodation purposes to be adults.

(b)
Children aged eleven(11) and under, but excluding those aged two(2) and under are charged at 75% of the Adult Rate.

(c)
Infants (two years and under) are free, except if a Cot is required, which is charged at VUV 950/night.


3.02
CHECK-IN AND CHECK-OUT : Check-in is formally 14.00 pm and check-out 10.00 am. While we have no choice but to strictly enforce this policy during periods of heavy and ongoing bookings, at other times this policy can be relaxed - provided the rooms are not booked the previous or subsequent days to the time of your stay. When possible, early check-in and late check-out are synchronised with flight arrivals and departures of the day. If you are picked up from the airport before your room is available, we will store your luggage in our storage room.


3.03
COMPLIMENTARY ISLAND CONTINENTAL BREAKFAST: All guests have a complimentary Continental breakfast available, consisting of fresh seasonal tropical fruit, toast and tea or coffee.


3.04
LUNCHES AND DINNERS : Lunches are on a 'Plat due Jour' basis and include contemporary island meals using locally available ingredients.


[ 4 ]BASIS OF TOURS & WALKS CHARGES.

4.01
CHARGES FOR ADULTS, CHILDREN AND INFANTS:


(a)
Adults are charged at full rates as detailed on our website and booking engine, and any person twelve(12) and over are considered for Tours & Walks purposes to be adults.

(b)
Children aged eleven(11) and under, but excluding those aged two(2) and under are charged at 75% of the Adult Rate.

(c)
We have no control over entrance fees charged by the various facilities such as the 'Volcano Guides'. This being the case, we have no choice but to charge full fare for entrance fees for children. If Esso is able to obtain a reduction for your children, an adjustment will be made by Esso at the end of your time with Tanna Adventures.

(d)
Infants ( two years and under) are free of our charges (although entrance fees need to be confirmed). However, while it is your decision whether or not to take your infant up to the Mt Yasur Volcano Rim, we do not recommend this and advise caution.


4.02
TOURS ARE WEATHER, ROAD, & VOLCANO DEPENDENT:


(a)
Due to the fact that Tanna Island lies in the tropics and all roads are unsealed and subject to significant erosion during periods of heavy rain, this trip is dependent both on weather and road conditions (This is the same for all trips carried out by all tour operators on Tanna).

(b)
In particular Participants are to note that in the end its up to the Mount Yasur Volcano Guides to allow you to visit. If Volcanic activity is such that the Guides have closed the Mountain ( see Vanuatu Volcano Alerts System), then Participants must accept this as a a part of the unpredictablity of mother nature.

(c)
Please understand if the trip is rescheduled to suit. Participants are recommended to allow enough days on Tanna Island to account for any such eventuality.


4.03
POSTPONEMENT OR CANCELLATION:


(a)
Should the trip be postponed due to conditions then , subsequent days will be offered if these are suitable.

(b)
Should the Tour have to be cancelled due to conditions, or if Participants cannot make a subsequent tour that is offered, then no further charge will be made in respect of 'that Tour' in the Final Payment. The Deposit paid in respect of 'that Tour' is not refundable however.


[ 5 ]BOOKING ACCOMMODATION AND/OR TOURS & WALKS.

5.01
YOUR TOTAL TRAVEL COST : Your total travel cost includes the cost detailed in your quote or invoice plus the added cost of meals (that are not included within your quote), and extra Tanna Adventures services and products purchased while travelling with Tanna Adventures.


5.02
PAYMENT IS MADE IN TWO PARTS : Payment consists of the payment of two separate and distinct sums of money : -


(a)
A Deposit at the time of booking to secure a confirmed booking, and

(b)
A Final Payment at the end of your time with us.

The Deposit is paid in either American (US$), European (Euro), Australian (AU$), or New Zealand (NZ$) Currency. We accept payment of the Deposit either by PayPal, credit card (Visa or MasterCard only ) or Bank Transfer. The Final Payment is made in Cash (Vatu) to Esso at the end.


5.03
YOUR DEPOSIT : The Deposit required for Accommodation is 50%, while that for Tours & Walks is less depending on the makeup of those Tours & Walks, but will be provided to you at the time of Booking. By paying the Deposit you will secure a confirmed Accommodation and/or Tours & Walk itinerary.


5.04
FORMAL CONFIRMATION DOCUMENTATION : Once you have paid your Deposit we will send you your Formal Documentation (PDF format), by email. This consists of our official receipt along with your confirmed formal itinerary, which also provides you the breakdown of your Deposit, along with a clear statement of what is left to pay (minus extras, such as lunch and dinner meals) for your Final Payment.


5.05
YOUR FINAL PAYMENT : Your Final Payment is due at the end of your time with Tanna Adventures, and must be paid in local currency (Vatu) to Esso. Your Final Payment will be based on your Formal Documents, but will include Lunches, Dinners and any other service or product you order while with Tanna Adventures. Esso will provide you with a Final Invoice taking into account the payment of the Deposit. The Final Payment is made in Cash (Vatu) to Esso at the end of your time at with us, and you should ensure that you have sufficient Vatu for this.


5.06
ADVICE OF PICK-UP AND DROP-OFF TIMES AND DATES : We will be in contact with you to advise pick-up and drop-off arrangements once your have fully paid your Deposit, at the time of issuing you yopur Formal Documentation. All queries in regards to your booking arrangements should be directed to the contacts listed on our website.


[ 6 ]HOUSE RULES AND CUSTOMER BEHAVIOUR.

6.01
BUILDINGS ARE NON-SMOKING : All buildings are non smoking, guests agree not to smoke within any building on the Tanna Adventures Property, and to remove and dispose of any butts etc of their members from the property.


6.02
NOISE RESTRICTIONS : Guests shall contain noise at a reasonable level and, in particular, between 10pm and 8am.


6.03
SHOW RESPECT AND BE COURTEOUS : Customers shall at all times show respect and behave courteously towards Tanna-Adventures staff, their families, and other Tanna Adventures Guests and/or Participants. Further, Customers shall at all times show respect towards local Ni-Vanuatuan 'Kastom' and culture.


6.04
REQUESTS BY TANNA ADVENTURES STAFF : Where Tanna-Adventures staff make requests of Customers in accordance with these Terms and Conditions, these shall be complied with by Customers.


6.05
CUSTOMER BEHAVIOUR : Customers shall not engage in any drunken, obscene or antisocial behaviour.


6.06
TERMINATION OF A GUESTS STAY, OR PARTICIPANTS PART OR PLACE IN A TOUR OR WALK : Tanna Adventures reserves the right to terminate the occupancy of any Guest on the Tanna Adventures Property, or terminate any participant on a Tanna Adventures Tour or Walk, who :


(a)
Intoxication and/or unsavoury/lewd behaviour; or

(b)
Wilful damage to Tanna Adventures Property, Vehicles or Buildings; or

(c)
Physical or verbal abuse/assault of our staff, other guests / participants, members of the public on or around the Tanna Adventures Property, or on a Tour or Walk; or

(d)
Any behaviour deemed as a potential safety threat to others; or

(e)
Any incident for which police are required to attend.

Guests or Participants (as applicable) will leave immediately and shall NOT have any right or recourse whatsoever for any eviction, or termination of their Stay, or Participation in a Tour or Walk.


[ 7 ]BOOKING CANCELLATIONS.

7.01
YOU ARE OBLIGATED TO NOTIFY US : If you cancel your booking for any reason, you must notify us in writing (by email is sufficient provided we provide a confirmation email that we have received it).


7.02
YOUR PREPAYMENT TO US : Your pre-payment to Tanna Adventures is the Deposit only. We do not take full payment up front, and your Final Payment occurs only at the end of your time with us. Any refunds you receive from us, and conversely any loss of "monies" you incur, as a result of you cancelling your Booking is in regard to your Deposit only.


7.03
CANCELLATION 28 DAYS (OR MORE) AWAY FROM COMMENCEMENT : For cancellations made more than 28 days away from Commencement - 100% of your Deposit (minus bank/merchant facility fees) will be refunded.


7.04
CANCELLATION BETWEEN 14 - 28 DAYS AWAY FROM COMMENCEMENT : For cancellations made less than 28 days away, but more than 14 days away from Commencement - 50% of your Deposit (minus bank/merchant facility fees) will be refunded.


7.05
CANCELLATION LESS THAN 14 DAYS AWAY FROM COMMENCEMENT : For cancellations made less than 14 days away, from Commencement your Deposit is fully non-refundable.


7.06
REFUNDS SUBJECT TO BANK/MERCHANT FACILITY FEES : Any refunds shall be subject to any deductions made by PayPal, Credit Card companies or Banks as applicable to the transfer on monies.


7.07
IF YOU SIMPLY DON'T SHOW UP : If you simply do not turn up without notifying us in writing shall be taken as a No-Show, and in this case you authorise us to take payment for the full amount of your Quoted Price given to you and accepted by you as a part of these Terms and Conditions.


7.08
EARLY DEPARTURE : No refund will be given for early departure, and you will be required to pay for the full time of your Accommodation Booking on your Formal Documents.


7.09
INCLEMENT WEATHER AND ILLNNESS : Refunds cannot be made for bookings cancelled due to inclement weather or illness, and you will be required to pay for the full time of your Accommodation Booking on your Formal Documents. We recommend that you take out comprehensive travel insurance to protect you in this regard.


7.10
BOOKINGS MAY BE TRANSFERED : Bookings may be transferred (once only) to a future date, provided that the request to transfer : -


(a)
Is made at least 28 days before Commencement, and

(b)
Is for the same Bungalow and/or Itinerary, and

(c)
Any extra days and activities included in your future booking are paid for, extra to your quoted price, and

(d)
The re-booked Commencement date is not later than twelve(12) months after the original Commencement date, and

(e)
The initial Deposit paid shall be held over by Tanna-Adventures for the transferred booking, with any difference due also paid by the guest at the time of making the 'transfered' booking, and

(f)
The applicable tariff's at the rebooked date ( if different to the initial tariff) is applied to the entire booking, and the original amount deducted. The difference (in the Deposit) is to be paid for at the time of carrying out the 'transfer' booking, with the revised tariff's also being applied to the Final Payment Formal Documents.


7.11
CANCELLATION BY TANNA ADVENTURES : If the Premises becomes unavailable for occupancy before or during your stay due to damage to the Premises, or due to the need to carry out emergency repairs as a result of damage to the premises or due to circumstances beyond the reasonable control of Tanna-Adventures, we will endeavour to find suitable alternative arrangements for your stay. If satisfactory alternative arrangements cannot be made, we will refund monies paid for that part of the booking not fulfilled.


[ 8 ]LOSS, DAMAGE OR INJURY.

8.01
EXISTING DAMAGE TO BUNGALOWS : If on arrival you notice any existing damage or breakages within the Bungalow, that are not consistent with the nature and locale of the property, you must report your concerns regarding the condition of the Bungalow to us immediately after your arrival. Otherwise it is agreed that all is in order with the property.


8.02
UNREASONABLE DAMAGE THAT IS CAUSED BY YOU : You will be held responsible for any unreasonable damage, breakages, theft or loss on or in the property shown to have been caused by you during your stay. If any premises is affected in this manner, that is not consistent with the nature and locale of that premise, you will be responsible for all related costs for the repair or replacement of the affected premise. You authorise us to charge you and you agree to pay these costs.


8.03
THEFT OR INJURY : Neither 'Tanna-Adventures' nor its staff takes any responsibility for the loss or theft of your personal property or for any bodily injury that occurs on or at the Premises. We recommend all guests purchase travel insurance to cater for any such eventualities.


[ 9 ]TOURS AND WALKS.

9.01
TOURS & WALKS INVOLVE RISK AND INTERACTION WITH HAZARDS : You acknowledge that various Tours and Walks that you may go on are adventurous and your participation involves a degree of personal risk. It is your own responsibility to acquaint yourself with all possible hazards and their consequences to yourself and those travelling with you. You acknowledge that our decision to travel is made in the light of consideration of this information and you accept that you are aware of the personal risks associated with the participating in Tanna Adventures Tours and Walks.


9.02
YOU SHALL ENSURE THAT YOU DO NOT OVERREACH YOUR COMPETENCY OR ABILITY : You shall ensure that both yourself and any member of the group of people that you have booked on behalf, do not overreach their competency or ability in regard to any physical endeavour whatsoever, whether that is associated with a Tour or Walk, or on the Tanna Adventures property. Should you or any member of your group feel that they are about to overreach their abilities, they are to notify the Tour or Walking Guide, or the relevant Tanna Adventures Supervisor. At that time you shall discuss your situation with that Guide or Supervisor and subsequent to this, you shall decide either to continue with help, or alternatively to wait until a designated person arrives to help you proceed back to the starting point.


9.03
CHILDREN ON TOURS & WALKS : You shall ensure that children are adequately supervised by yourself, at all times to ensure their safety, and you are to be extra vigilant around hazards which may pose dangers to them on Walks, Tours and on the Tanna Adventures property generally, at any time of day or night.


9.04
ITINERARIES MAY CHANGE WITHOUT NOTICE : The tour itineraries are always subject to possible changes due to dangerous volcanic activity, weather conditions and/or restrictions imposed by local authorities. Tanna-Adventures has the right to alter the program itineraries and times without prior notice if this becomes necessary. In such cases, Tanna-Adventures will try its best to find appropriate, equivalent alternatives; if major parts of a program unexpectedly become unavailable and no equivalent alternative can be found, a reasonable deduction (or refund) will be given to the clients, in form of an amount of money equivalent to the saved expenses.


9.05
WE TAKE NO RESPONSIBILITY FOR FACTORS OUT OF OUR CONTROL : Tanna Adventures assumes no responsibility for any damage, loss, accident, sickness or program change caused by weather, volcanic activity, or regulations imposed by local authorities. We advise all clients to have comprehensive travel and health insurance.


[ 10 ]TOURS INVOLVING MT YASUR VOLCANO.

10.01
YOU ACCEPT THAT ACTIVE VOLCANOES ARE VERY DANGEROUS : Participants should note that visiting any active volcano is potentially very dangerous. It is your own responsibility to acquaint yourself with all possible hazards associated with being in close proximity with a Volcano and their consequences to yourself and those travelling with you. You acknowledge that our decision to travel is made in the light of consideration of this information and you accept that you are aware of the personal risks associated with participating in one of Tanna Adventure's Mt Yasur Volcano Tours.


10.02
YOU SHALL FOLLOW THE ADVICE AND GUIDANCE OF THE VOLCANO GUIDES : The Entrance and Governance of Mt Yasur Volcano lies with the "Mt Yasur Volcano Guides", who charge an entrance fee ( which is included in your Tour package), and are responsible for managing whether the Volcano is open (safe to view), and where people are permitted to view from. Your entrance onto any part of the region managed by the "Mt Yasur Volcano Guides" shall constitute your agreement that you will at all times follow their advice and instructions.


[ 11 ]YOUR ACCEPTANCE OF RISK AND LIABILITY .

11.01
YOUR ACKNOWLEDGMENT OF RISK : You understand and acknowledge that your travel in connection with and participation in the travel package arranged at your request by Tanna Adventures may involve risk and potential exposure to accident and major injury. You also realize and acknowledge that risk and dangers may be caused by the negligence of the owners, employees, subcontractors, or agents of Tanna Adventures or the negligence or participation of other participants and/or guests. You also recognize and acknowledge that risk and dangers may arise from foreseeable and unforeseeable causes, including weather and other acts of nature. You fully understand and acknowledge that the aforementioned risks, dangers and hazards are a potential in connection with recreational activities which may take place during your time with Tanna Adventures.


11.02
TRAVEL INSURANCE IS NOT INCLUDED IN OUR PRICES AND QUOTES : Travel Insurance is NOT included in our Prices and Quotes to you. We endorse the recommendation of the Department of Foreign Affairs of your own Country, that all travellers take out travel insurance. It is your personal responsibility to purchase your own travel insurance to cover any liability or contingency which may occur.


11.03
TRAVEL INSURANCE : Your travel insurance should provide cover against personal accident, death, medical expenses and emergency repatriation, with sufficient cover in each of the above categories. We also strongly recommend that it covers cancellation, curtailment, person liability, loss of luggage, and personal effects. Your travel insurance company should be able to advise you on an adequate level of cover.


11.04
EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY : In recognition of the inherent risk of the travels and related activities in which you are intending to engage, you confirm that you are physically and mentally capable of participating in the activity, that you are willingly and knowingly electing to participate in this travel package in spite of the potential risk of danger, and you willingly and voluntarily assume full responsibility for any injury, loss or damage suffered by you or caused by you, whether caused in whole or in part by the negligence of the owners, agents, employees, or subcontractors of Tanna Adventures.


11.05
RELEASE OF LIABILITY : In consideration of the services and arrangements provided by Tanna Adventures, you, for yourself and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless and agree to indemnify Tanna Adventures, and its owners, officers, directors, agents, contractors, subcontractors and employees from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection with the scheduled travel package and any activities conducted in conjunction therewith.


11.06
EXPRESS WAIVER OF ANY RIGHT TO SEEK CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES : Regardless of the situation or circumstances giving rise to a claim, you waive any right to seek consequential, punitive or exemplary damages against Tanna Adventures, their owners, officers, directors, agents, contractors, subcontractors and employees, for any reason whatsoever.

PAYING DEPOSIT REPRESENTS YOUR AND YOUR GROUP MEMBERS AGREEMENT TO WAIVE ANY RIGHT TO SEEK CONSEQUENTIAL PUNITIVE OR EXEMPLARY DAMAGES : In consideration of participating in your Tour and Walking itinerary, your payment of the deposit indicates that you have, on the date shown, read and understood these Terms and Conditions and acknowledge that it affects your legal rights and agree to be bound by its terms. You also acknowledge that all members of the group of people that you have paid the deposit on behalf of have also read these Terms and Conditions, and Jointly and Severally acknowledge that it affects their legal rights and agree to be bound by its terms.
Payment of the deposit also signifies your intention to relieve and indemnify Tanna Adventures, their owners, officers, directors, employees, agents, contractors and subcontractors from any liability for personal injury, property damage or wrongful death which you or the group of people you have booked for might suffer during your participation in the scheduled itinerary.
